PPI on loan after court action

My girlfriend and her ex partner had a loan which he said he would pay when they split as she couldn't possibly afford it. He didn't pay the loan and it went to court where she offered to pay £100 per month. The court hasn't caught up with her ex so all the repayments are loking like they will be made by her (or me as the case may be). Can she still claim a missold PPI back after court judgement on the loan?

Hi and welcome.
I am not sure how it works in these circumstances but maybe dunstonh or someone will know and post up soon.;)The one and only "Dizzy Di"0 -
IF you think that she has a case for claiming miss-sold PPI then the court action does not mean anything. The Financial Ombudsman will still look at a case if the previous court action did not look at the actual sale of the PPI.
It seems to me that the Court action was just about the actual loan, not about the sale of the PPI so you (she) can still make a claim. Best thing to do is read the guidance on the FOS website http://www.financial-ombudsman.org.uk/publications/technical_notes/ppi.html and then if you think that your girlfriend has a case, then get her to complete the consumer questionnaire and then send it to the company.
Good luck! We've spent decades teaching people about their rights, but nothing about their responsibilities.0
