Hung out to dry by council. Can I claim?

Options
I went swimming with my sons recently and left our cloths and valuables in their lockers in the changing area. Our locker got broken into all was taken about £510 to replace everything. I contacted the council and was told they need to be proved negligent and no compensation was offered.

I went back to the pool and noticed there were no disclaiming signs stating they accepted no responsibility for customers belongings left in the lockers. I persieved this as negligent and asked for my claim to be honoured. There reply was on your bike. However they have now got these signs in the pool and have admitted in writing they were added after my gear was stolen.

Im'e toying with the idea of taking them to the small claims anyone got some better suggestions.

You do realise that you have posted on the Benefits board? If you PM one of the Boardguides they can move your thread.

With regard to your 'claim', you do not need a sign to exclude liability. You still need to prove negligence, and short of expecting the council to CRB check everyone that comes in or no working locks, you are going to find that very difficult.

Have you checked whether you are covered for the loss on your home contents policy?

Two half decent phones could easily come to that much. My handbag plus it's contents would come to well over that.

Expensive phones should be insured. If you cant afford to loose it and all that...

And more fool you if you walk around with £500+ in your handbag.
  • OP, Firstly, have you reciepts for what you wish to claim (i.e. proof of purchase)?

Having signs disclaiming responsibility is not tantamount to negligence resulting in your having your items stolen. Two completely seperate issues here. Unless the lockers were faulty and you can prove some level of negligence that resulted in your losing your stuff your claim will fail.

emmm quick question have you reported it to the police?

dont think the courts would take it further without a crime reference number to validate the fact that theft took place
