[QUOTE=mrdogcat;35826907 Either way am I right in thinking I have to now deal with Brian Carter from now on? :-(

I also haven't told BC my new address (they rang me at work) should I give them it? :-/

    It's all very confusing![/QUOTE]

Under no circumstances give Brian Carter your address.

These DCA's are not concerned with the merits of the case - they just want the money!

No problems with your bluntness Malc, I need to go through this with my eyes open. I rang E.on like you said, to which they said they'll send me all the bills I never received and for me to now speak to Brian Carter as they have now bought the debt. The guy over the phone said it's nothing to do with them anymore and wouldn't put me through to your Credit Management people or talk about setting up a payment plan. :-/

I FAXed the transfer of equity to Brian Carter so I'll have to wait to hear what they say...They did say yesterday they would present it to E.on but not sure if this is correct since E.on say they don't have anything to do with the debt now. The BC guy could have that bit wrong maybe? Either way am I right in thinking I have to now deal with Brian Carter from now on? :-(

    Hi mrdogcat

No need to give Brian Carter your address. However, I would speak to them.

As they now have the debt, they will be in touch with our credit management people and will let them know about the info you have provided.

If it is decided to close the account to the earlier date, we will become involved again in order to carry out the necessary adjustments. However, if this is not possible, the debt will remain with Brian Carter and you will need to deal with them.

Also, you will be able to set up a payment arrangement with Brian Carter.

Hope this clarifies things a little mrdogcat. Give me a shout if I can advise further as will be happy to help.

  • So yesterday I got another call from Brian Carter telling me that they've not heard from me since they last called.

I told them I sent them a FAX - They told me they didn't receive it.

I told them I spoke to E.on and that they said I needed to sort it out with B Carter and not them - B.C. told me E.on wouldn't have said that... okaaaaaay they must have lied to me then.

B.C. ended the conversation saying they will record this conversation and it may have to take me to court now.

    What's my next move? :-(

Not sure the post above is correct.

Brian Carter Solicitors are presumably one of the dreaded Debt Collection Agencies(DCA) and they certainly will not be interested in the facts - they want the money from the easiest source.

Presumably your Ex gave them your new Phone number?

If you moved out 'legally' in Jan 2008 you are not responsible for any bills from that date - gas, electricity, water, council Tax etc. If the gas bill has come your way, what is to stop the others coming if you acknowledge responsibility for gas?

I wouldn't pay on principle and take the matter to court if necessary.

I agree with Cardew. You can either fight or be walked all over again. I know what I would do! :)

Personally I would write to Eon (if you wish by recorded delivery), both outlining the facts as you see them and including any offer you are prepared to make them. Also, asking for written confirmation as to who owns this debt. If they haven't sold it to Brian Carter then I would tell them both that you will only speaking directly to the organ grinder and not the monkeys in future. Speaking to a third party offers you no benefit whatsoever, they are only used in an attempt to frighten you.
