Baillif Letter when no PCN was received

Hi All,
I have recently ( 6 August 2010) received a letter from Equita for an "unpaid PCN" from Newham Council and I never received any communications on this previously. I have since filed and OOT and Statutory late Declaration application and now waiting to hear back.
I have called Newham Council and just found out the that reason I never received the letter is because there were not addressed to me but rather to "the company secretary" when they have my full name and address. I wish to appeal formally on the grounds that the PCN was never issued to me and within the appropriate timelines, I've been advised that the PCN date was 27 November 2009.
Can someone please advise as to what my next step should be ?

I would copy & paste your question onto a new thread you can start over on pepipoo.com. If you haven't discovered it already, that forum is a motorists' fightback board with specialist and experienced advice on this sort of issue:

Basically I believe that the action you have taken re-sets the case back to Notice to Owner stage. Then you will be able to make formal reps to the Notice to Owner - but get pepipoo's advice on the appeal because they always have more flaws in paperwork to point out and add to your appeal than you would ever imagine!
Are you certain the bailiffs have been called off (if not then urgently phone TEC, phone the Council, make sure your forms have been received and acted upon).
Oh yes, and as Coblcris says you will probably need to file an N224 as well in due course because I think OOT declarations are always responded to with a refusal. Don't let it put you off, that's always the response because the whole thing is a game of bluff. Shocking, isn't it?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
