2 PCN's within a hour and a half of each other

Hi there,

I was wondering whether someone could help me out.

I received two PCN's within an hour and a half of each other. One was a ticket on my car which I paid. About 2 weeks later i received a letter in the postt and just assumed that this was the PCN I ahd already paid. It was only upon receiving a reminder that I called the council and questioned it. It was infact a second PCN which had been captured by one of those cars with a camera.

The contravention was the same contravention. My car had not been moved and if they had looked they would have seen that a ticket had been slapped on my windscreen.

Surely they cannot do this?

Does anyone know of any legislation regarding this??

Any help would be appreciated.

  • What did the council say when you phoned them, its not clear. Did they say it will stand?
    If so take a copy/photo of both the tickets, both sides, remove personal details and host on tinypic. Copy the url and paste it into this post and remove the http:// bit. Someone with knowledge will help you.
    You could also post all onto pepipoo.com as well.

    So you need to appeal in writing, on the basis that the relevant amount has already been paid for this contravention.

    Quote the other PCN number, and remind them that Council are supposed to only use cameras to issue PCNs in places where it would be difficult to enforce on foot. They've already enforced this contravention on foot and you've paid - so you expect the second PCN to be cancelled forthwith.

    Post back again if you get a rejection to your appeal. Was the 'reminder' a Notice to Owner?' You must make your reps before the deadline, do not delay.

    If you want further help then post about it and show pics of your paperwork on pepipoo forums. Shame you didn't ask them re the first PCN as they can usually find flaws to appeal on which will get most PCNs cancelled:

  • they said that I would have to make representations within the 28 day period - which i did. I received a charge certificate and then an order for recovery. I have my fax confirmation to show that is ent my representations within the specified time but I never received a letter to say that they rejected my representations. Now I have to make a witness statement.

    I just wanted to know if it was set down in law that this is something which they can/cannot do?

    OMG you didn't say that before. You are at the stage of Bailiffs calling.

    Post about this on pepipoo for advice right now, you may have to hide your car off-street tonight if the Bailiffs have not been called off.

    Not even sure that sending reps by fax would have been acceptable, was it given as an option? Not to worry, get over to pepipoo and listen to what they tell you, it's very important.

  • Well half of the problem is that I moved whilst this has been ongoing.. they are sending the letters to my old address. I put my new address on the letter i made the representations on yet they have still sent post to the old address. They certainly wont find my car around there!

    Yeah it said on the back that it could be done by fax and had a number under how representations could be made.

    The bailiff could easily find you. Send that fax asap, also phone TEC in the morning.
