Good evening guys!

On Friday 11 June 2010 I purchased a bengal cat from a breeder in Norlfok. Within 24hrs I noticed that the cat was showing signs of ear mite; he was shaking his head and scratching his ears etc. So I called the breeder and asked her advice, she advised me to get some ear mite powder. The following day the cat seemed fine, so I assumed he just had an irritation in his ear and he was ok. he didn't show any other signs until the Wednesday.

On Wednesday 16 June, the cat was very ill; vomiting and excreting feaces on house hold soft furnishings, which have now been replced. I took him straight to the vet, who claimed it was one of the worst cases of ear mite she had ever seen; the cat was also really aggressive. I paid for the necessary treatment and went on my way. From that day, I was unable to go anywhere near the cat for fear of being attacked; he was so aggressive. I even took it upon myself to take some time off work 5 days), to be with the cat. The last straw was when he went for a friends young (4 yo) daughter. I told the breeder that I needed to bring the cat back because of his aggression, as I could not possibly live with it.

I have taken the cat back and she is refusing to give me a refund; claiming that she has a no cash refund policy.

Where do I stand with regards to this so called policy? I was not maded aware of it prior to purchasing the cat, nor had she mentioned it until I took the cat back.

I want to take this to a small claims court, but I'm not sure whether I've got a case; this is where you guys come in.

  • No doubt she will claim she was doing you a favour by taking the cat back!
  • When I took the cat back, I thought I was doing her and the cat a favour.

    She treats her cats like there her children and apparently loves them sooo much, also I didn't want to take the cat to the local Cat Protection League; which is just round the corner from me and with his aggression I doubt they could rehome him anyway. Instead I took him back to where he originally came from, which was 60 miles away; so it cost me again.

    I really don't see what you can claim for.

    You should perhaps have had the cat vetted before buying (as is done with horses)

    You bought a cat and not a kitten so the question has to be asked why was she getting rid of it, perhaps more time spent ascertaining it's character might have helped.

    Buyer beware as far as I can see. Should probably have gone back with it straightaway (ie after first vet visit ) and you "might" have had a chance.

    Thanks for that. The breeder told me that the cat had been vet checked previous and I sat with the breeder, her family and the cat for about an hour before taking him home. He was fine.

    I don't know how old the cat was but we have a bengal who is now 6 and has only just mellowed into wanting to sit on knees etc. The breed is reknmwned for being quite agressive and terrertorial, but then mine does originate from the asian leopard cat!!

    When cats are poorly they can get agressive plus being in a new home aswell.

    Did you research the breed before purchasing so you knew what you were getting?

    As for the predicament I'm not sure but I would hazard a guess that the onus is on you rather than the breeder but as I said that is only a guess

  • When we got Monty from the Cat Propagation League, he was livid. he bit,scratched and belted around like a leopard possessed. With affection, and a bit of ribbing and jabbing, he calmed down in about 3 to 5 months and Freda and mes would not miss him for the world.

    he still dabs everyone, except me, and his aunt who looks after him when we are out, gets plenty of his attention.

    As for the CPL, see my first remark.
  • why was the breeder getting rid of him? Was he previously used for breeding and therefore isn't neutered?

    I've just rehomed a 3yr old female and she's been with us now for over 3 weeks, but she is so gentle and affectionate. it's
    like she's never lived anywhere else.

    She now sit's on my knee and sleeps at the bottom of my bed - so playful and a nosey wee toe-rag but loves being stroked.

    She is a 4th generation Bengal and is a joy.

    but if I'd paid money for a cat I want the vet cost back becuase it was obvious he had the ear-mites when you got him.
