    Don't go there! You'd have to rack up considerable costs upfront to do what you suggest; with no guarantee of receiving the money back.

    Follow the SoGA/inherent fault procedure or just drop it.

    OK, would SOGA apply as usual but taking into account the 'like new' status of the product, i.e. it should last a reasonable amount of time?

    Yes. Since more than 6 months old though, burden of proof is on you, ie. you need to show inherent fault (see post #10).

    the company is refusing to supply the documents they stated will be used as evidence in court, even under my CPR 4.3 request and are instead asking for a report that the fault was not damage. Since i am asking for documents that exist and they are asking for something that doesn't, who is right?

    also, they won't provide a name and addess to send court documents to.

    I think you've been advised of this before but outwith 6 months, the burden is on you to prove the fault was inherent and has not been caused via misuse or wear and tear. You do so my obtaining a report - which if fault to be inherent, you would expect to be refunded.
