cineworld mess up

hi, serving in the forces i was up north for a while, i decided to subscribe to cineworlds unlimited card. giving my card and general details i had no problem untill the month after. down south now i was told my card no longer worked, the guy serving me in the cinema after much frustration on the phone trying to sort it out said not to worry if i didnt want it any more just leave it. not at all bothered by the card no longer useable and no charges i left it.

three months later i recieved a text message asking me to contact a debt collection agency. very shocked and scared as bills are always payed on time with no problem EVER (saving up for a house with girlfriend). anyway contacting them they told me it was £60 for cineworld and if i had a problem contact them.

so i did, after speaking to many rude supervisors telling me i was written to emailed etc of which i had not as i store such things, being told then it may perhaps of been stored as junk as many people have complained before (why they didnt ring me, i dont know?) we found to be the problem that the young girl taking my details up north had confused the second digit of my sort code.

getting through to the manager she was more helpful. and straight away realised the fault layed with them. calling back the debt collection for the moment i await for a phone call at this time. am i liable to pay the £60 even if i havent been using the card? do i demand they write and provide proof that there mistake hasnt effected my credit history?

any advice would be appreciated.

  • it didnt work as cineworld automatically cancelled the card due to non payment, they had the wrong sort code not known to me until the debt collection agency contacted me.

    You contract in for 12 months when you first apply for the card. And obviously, you still pay for the card whether you use it or not as its on a per month basis and not a per film.

    You might be better asking on the debt board, but imo your best bet would be to ask the cinema to take care of this seeing as it was their mistake - however the problem does come in proving they told you just to leave it.

    I know my friend had something similar happen when he tried to use a prepaid visa card and it wouldnt allow direct debits to be set up. He was given the option of paying it all upfront for the year or giving other bank account details.

    You agreed to the charges so you would be liable to pay them, except that as your card doesn't work Cineworld have not been providing you with the service they agreed to. As they have broken their side of the contract they can't force you to pay your side.
  • thank you all for posts, ive now paid the money (directly to cineworld) and a letter saying it was there fault is in the post. ive been told no marks have been put on my credit rating. also the manager has put some credits on my account to balance out the months the card was inactive.

    overall though i have been disgusted in way i have been treated.
