Advice needed please!

Hi I'm just looking for a bit of advice.
I wrote to rbs in April requesting payback of ppi on a loan.
I got a reply last week saying I had no claim as I had signed that I wanted it.
I had filled in a questionnaire stating the loan was sold over the by someone in my local branch and faxed to a branch near my workplace-I was told I had to sign that day so I went in my lunchbreak and signed it-I therefore did not have time to read all paperwork and signed where instructed by the staff member.
Rbs say they did not receieve the questionnaire so based their decision on the forms I filled. They sent me copies of the forms and on two occassions iv signed the relevant parts but I haven't ticked the clearly labelled boxes which state to tick if I want the ppi.
I'm just wondering what the best course of action is now-I contacted fos who said they'd send a complaint form but I'm wondering if I should contact rbs first with this further information? Any advice would b appreciated.
Also should I cancel my ppi now? Would it affect any decisions made in the future? Thanks! Ps-sorry for rambling!!!

    Hi and welcome.

I would if you can keep it going until resolved, because I am not sure if it would get reduced by much until actually resolved if cancelled right now.

And was that the final decision you received?
In the actual final decision they do let you know its final and send the leaflet details of the FOS.;)

Hi there, will post what I posted on your other thread lol :D

Anyway this means you do have the opportunity to write back with anything further until you actually receive the final decision, they should make this clear, and at the same time enclose the leaflet details of the fos.

Below my post from your other thread......

Have just left you a post on your other thread, but if that wasn't the final decision you are entitled to write back with further information.

If you feel they have overlooked and not even taken your reasons into consideration, then tell them that and tell them your aware that the FSA are punishing banks for not investigating properly and for rejecting genuine complaints.
Did they explain the policy to you?

When mine was sold to me in the bank lloyds, it was a rush job and I was only then receiving the children's benefits, I did not tick for it but there was an automated crossed already on it, I used to think it was all part of being accepted.

If you decide to write to them give them 14 days to get back, as I note that you said about receiving some fos complaint forms, so if you don't get the result your waiting for then complain to the FOS.

    Hope this helps.;)

Thanks. Iv now written a strOngly worded letter stating the facts! Can I ask for a reply within a set time? I already waited 3 months for the first one!
  • I got a reply last week saying I had no claim as I had signed that I wanted it.

thay can not use this as an excuse under FSA guidlines as the could still have wrongly advised you to take it.
FSA 10/12, FSA 10/36 PPI Complaints Resolution Instrument, sections 3.3.5 to 3.3.13
3.3.5 G The firm should not reject a complainant’s account of events solely on the basis that the complainant signed documentation relevant to the purchase of the policy.

write back and ask them to reconsider their decison and to answer all your complaint concernes, if they still do not uphold then go to the FOS.
I'm proud to say that the banks no longer take money from me after becoming debt free

Thanks again. the letter they sent said I'd been given the ppi on a non-advice basis so I'm hoping this'll back up my point that I haven't ticked the boxes and have signed where I was directed to without being given any advice. I'll post the letter tomorrow so fingers crossed the reply this time will be more positive! Thanks for all your advice x
