House falls through, who pays solicitor>?

Hello, currently trying to sell my house but the purchaser wanted to complete last friday, but when it came to friday she told my EA that she would exchange on her house friday and on ours sometime this week.

Not been able to get any more info since as the woman is not returning calls to my EA and neither is her solicitor.

So to me it looks like its about to fall through right at the last minute.

If this happens do I have to pay the full fee of my solicitor?

    Afraid so. It's not his fault, after all!!

    One of the perils of buying and selling houses...and one of the reasons you'll never see a poor Solicitor!!

  • We are currently still trying to sell our house to our buyers and trying to buy one,the owner of which has pulled out of 2 house now.
    If this all falls through,through no fault of our own we owe our solicitor the full costs up to nearly exchange on a sale and a purchase!!!!
    We have done nothing wrong in this chain as it has been our buyers buyer who first pulled out and then our vendor,so we are not happy and you don't think it is going to happen and its not fair,but unfortunately the solicitor needs paying still.
    This is the problem with the stupid system we have in Englnad that anybody can pull out whenever they feel like it.

    Some solicitors work on a no sale, no fee basis, have you checked to see if yours does?
  • No, worth checking but I don't remember the mention of that when we went with them.

  • When I instructed the solicitor I'm currently using, I was sent a welcome pack along with the quote. It stated that if the transaction did not reach completion, the fee would be payable at a certain value per hour of work that had been carried out, up to a maximum value of the originally-quoted fixed fee.

    Did you receive anything similar from yours?

    when i bought my house the solicitor asked me if i want to pay extra £40 as insurance. so if sale fail due to othere people I will not pay him his fee
    it was good idea and I have accepted but guess what the sale went through and I lost my £40
  • Thanks, I'll check when I get home if the thing goes pear shaped as expected I need to know.

    Thing is the sols have done !!!!!! all as regards chasing the purchasers sols so haven't exactly bust a gut for their corn.
