Parking Charge Notice - Excel Parking Services - Help

I received a PCN from Excel Parking services in July this year. We purchased a ticket (which I still have) and I fired off an email to inform them of this. I received a letter to say the charge would not be revoked as they say my vehicle contravened code 94 - parked without displaying a valid ticket. I think the problem they have is that only the numbers of my reg plate appear on the ticket, I don't know why this has happened, I thought nothing of this really but apparently I should have rung their helpline at the time.
I was advised by a friend to ignore any correspondence but I was still quite worried and I took the letter in to my local MP who in the same week had recieved 3 other complaints of the same nature.
In the meantime I have recieved another letter from Excel and the charge has increased to £100 and states 'notice to owner of intent to issue court proceedings'.
A few days later I recieved a letter from my MP that included a letter of response from Excel.
It basically says they won't revoke the parking charge because according to their operations data - there was no faults with the machines that day and so no reason as to why my vehicle registration number isn't on display.
I don't know what to do, my husband is beginning to think we should just pay the money because he is worried about further charges being added. Now my own resolve not to pay is beginning to waver. I'm annoyed because after all said and done they have lost nothing - I paid the money into the machine to park and now they are trying to rip me off on some technicality.

Read the 100's of other threads on PPC's and ignore any correspondence from them.
Do not contact them in way, and the will go away eventually, although they will send you a few more threatening letters.

Excel are a joke company that would be stupid to take you to court after the kickings they have received in the courts. The advice you have been given is sound. Save the money for a better use and do not be conned by the threatening letters. When the scam is over, tell everyone that private parking 'fines' are unlawful. There you go, that should put your mind to rest. Totally ignore the scamsters. Any more crap from them what comes through your door again, ignore.
Don't forget, it's costing them money not you. Tell all your family, friends and friends of friends just to totally ignore their begging letters.
Excel will not be going near a court anytime soon.0 -
legal position
all I can add is that is that if ANY parking company takes ANYBODY to court in an attempt to sue for what the company has invented as a FINE, the court will take no notice of the invented fine. Instead the company is only entitled to sue for the value lost. ie if you did not pay a days parking, they are entitled to days parking fee. If you parked over 2 bays they are entitled to an extra single fee etc. Only the government (central or local), via the courts, can set the level of fines. What the company is actually suing for is compensation - although they like to pretend there is a "fine" involved. In your case of course they did not loose any money - AND -they can not fine you for non-display.

You paid for the ticket, which I hope you have kept, therefore the value of damages they can seek is pretty much zero.0
