Mortgage PPI

Hello,

We were miss-sold mortgage payment protection in December 2006 when we remortgaged. We used APS who have since gone bankrupt, and they dealt with this. We were not told at any time about it nor do we have any paperwork, insurance policy number or what the policy covered. All we had from our new mortgage provider was a list of charges that they had taken from the money we had to come back and and one these was the insurance company and the amount of £3000.00 I thought at the time it was buildings insuance (a bit expensive though)and I know should have questioned this at the time but to be honest I didn't think too much about it this mortgage was a much better interest rate than our other one and we would be saving about £300.00 per month so I just wanted to get it settled.

Back in March this year we had a phone call from Premier Financial Recoveries stating that they felt we had been miss sold a policy she had the amount we paid and the insurance company and said they could claim this back for us. I had forgotten all about this and didn't think I could get it back as it wasn't bank charges or anything like that so as it was money we didn't know we had so to speak I said yes to go ahead and claim it back for us. I know they will charge a fee but as I said before it was money we didn't know we had. I have since looked at this site and people were claiming back mortgage ppi.

PFR have since passed our claim on to Deloitte in an attempt to speed up the claim I have written to Deloitte and e-mailed them to try to find out how the claim is going so far have not received a reply. I'm on the verge of writing to the insurance company myself and asking for the money back but I have no proof that we had taken the insurance out apart from their name on the list of charges which I could photocopy and send to them. We could really do with this money now as we need some new furniture and my sister is remarrying in three weeks. Should I phone PFR or Deloitte and find out how things are going if they cant sort this claim out for us maybe I should write to the insurance people myself.

Sorry for the long post but as the months go by I am getting more and more annoyed by this whole thing, annoyed with myself too:o for not looking into this more at the time. They had no right to sell us this insurance without our knowledge with no paperwork or policy number its as if we threw £3000.00 away and as I said we need that money now.

Is there anyone else out there with a claim similar to this? no policy number or paperwork etc.?

    If its single premium MPPI then its one of the easist things to complain about and over 90% of these get upheld (sometimes you have to go to the FOS but they will nearly always uphold the complaint). You can normally turnaround a single premium MPPI complanit really quickly as they cant really support what they have done. You have a snag in that the seller has gone and it would need to go to the FSCS. The FSCS are much slower but it does work on the same basis.

    MPPI should be set up monthly from your current account. When its done that way, its very hard to complain mis-sale. When its single premium, its s a doddle.

    The insurance company has no liability for the sale and will not refund the premium. The seller has liability for the sale (unless they were acting on behalf of the insurer).

    Problem you have is that even if you take over the complaint now and succeed, you will have to pay the claims company their chunk. Even though it appears that they have done nothing.

    Have you had an acknowledgement from the FSCS yet regarding your complaint?

    If not, you could argue that the claims company havent even started the complaints process yet with the FSCS and after 4 months they should have and you are instructing them to cease the complaint due to incompetence.

    Thanks for the reply, yes it was a single payment they just took £3000.00 out of the money we had coming back from a remortgage. I will chase this up next week:)

    So, basically, the claims company have done nothing. They should have got an authority from you and then contacted the FSCS to put the complaint in. The FSCS are slow in dealing with complaints but they do respond more or less immediately upon receipt of a complaint.

    Thanks for the reply.

    I'm going to phone Deloitte tomorrow and find out how much longer this is going to take. I don't know what the process is if they have to go to court like bank charges etc. I was told at the beginning it takes about six months or could be more or less. I suppose because APS who sold us the policy are now bankrupt it makes it more difficult but the insurance company who got the money for this policy are still around. Could the money be reimbursed by them? Should I write to them direct and ask for the money back ? I have no policy number all I have is their name on the list of charges my mortgage provider sent me but I could photocopy this and send them. But first I'll call Deloitte who are supposed to be dealing with this :huh:

    Just an update on this. I have called Deloitte and spoke to my contact there. She said she had got all the details together and passed them through to the department who makes the decisions (cant remember the name of the department) and I should hear soon regarding their decision. She said if I don't hear within 2 weeks I should call her again and she will give me an update. So hopefully this should be sorted soon.
