Car Insurance claim advice

    in response to the post above, no i havent contacted my own insurance as they believe people dont crash on weekends and so only open monday to friday 9-5. so Monday morning i shall be on the phone.

    just trying to establish were i stand as its been so long and i want to be armed with enough knowledge not to be fobbed off by my own insurers and the third party.

    i will be taking photocopies of all letters and forwarding to my insurer recorded delivery as advised.

    once again thank you for your advise people.
  • What a joke, and people wonder why some people don't bother with car insurance.

    This is what car insurance is for, ACCIDENTS, regardless of who is at fault.

    If it was your fault as long as you have cover you should not be having this hassle. This is not an issue you should be having to sort out it is up to the insurance companies to sort out.

    I'm not sure on the actual legal position of this but surely as long as you were properly covered at the time of the accident then it is YOUR insurance company that should be facing the court summons not you.

  • Ok Quentin, surely this means that there is ultimately no liability on philbro as he was properly insured at the time, otherwise it means the whole car insurance system is a total farce.

    Is that right?

    Is there any actual way that the other insurance company could actually make a legitimate claim against philbro in a court of law?

    There is no financial liability, as he is covered by his insurance policy.

    As explained, legal claims via the civil courts have to be made against the individual, not their insurer.

    Their claim against the OP will be "legitimate", but his insurance policy indemnifies him as far as any award the court makes against him.

    There's a chance, (it does happen, when the insurer's admin has let their customer down).

    But in such cases, the insurer subsequently gets the CCJ set aside.
  • I have just returned home this evening to find a solicitors letter on my doormat.

    I had an accident on 21st April 2010. I went into the back of a vehicle at a roundabout. I did not admit liability at the scene but did explain to a police officer that i was looking to my right to see if there was room for me to join the roundabout, when I looked forward the vehicle in front had stopped and I hit it.
    I received a letter from a firm of solicitors shortly after the accident informing me of two cases against me for compensation for whiplash. I forwarded this letter to my insurers and thought no more of it. On 14th June I received another letter from the solicitors telling me that my insurers had made no contact and asking me to contact my insurance company.
    I contacted my insuance and passed on the information and they told me to give the solicitors the claim reference and a direct number for them to contact my insurance. I again thought this would be the end of the matter.
    I received another letter today 26th August dated 24th August stating that they had contacted the insurance company and they were passed on to agents acting on their behalf called wns assistance based in Norwich and that they had written to this agent on 28th June and had not received a response from them. As a result of this the solicitors are giving me 7 days notice to get the agents or insurance company to deal with this matter or I would served with court proceedings.
    Bearing in mind that I received this letter at 6pm on Thursday 26th and it is a bank holiday weekend I have to try and sort this problem out tomorrow or be served with proceedings on tuesday. I have tried contacting both the insurers and the agents who only operate between 9am and 5pm Monday to Friday.
    I am now at my wits end what can I do?
