Buying a flat over a shop...

I am thinking of buying a newly converted (from offices) 2 bed flat over a curtain shop, is there any way I can make sure that they will never put a takeaway under it or to the sides of it????

I have freinds who have bought above a bookshop. It is now no longer a bookshop and is an "open air" fish market. ( ie they took the front and back walls out) the owners of the market decided to ignore all planning regs, restrictions and consents, and just did what they wanted & went ahead anyway. My freinds now feel constantly sick and are woken at 5 am every single morning. The council are not acting quickly enough.:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

The newbuild Shared Ownership development I'm moving into has shop units (not yet let) on the ground floor, with two floors of flats above.
When applying for my mortgage I expressed my concern that this would put me at a disadvantage and I might find myself unable to get a top-ranking rate. My mortgage broker told me that this was becoming less of an issue, especially in London, and that most lenders these days are more interested in the construction of the building.

There is no way you can ever be sure there will not be a Take-Away opened under it, although anyone intending to do so should apply for planning permission, which may or may not be granted.
However, something like a musical instrument (i.e. noisy) shop or an adult shop could open without needing any planning permission at all.(AKA HRH_MUngo)

correct well it was about 7 years ago when my brother had a flat above a normal shop.
boy did they regret not contesting the planning permission to turn it into a takeaway!
basically left theri flat unmortgageable for future buyers and had to accept £40k less via a cash purchase!
so just make sure you contest any planning application!0 -

Seriously though, I am going to withdraw my offer - the flat is perfect for me but I couldn't live with the risk of some sort of takeaway or similar opening below - it could never happen, but i can't risk loosing all that money if it did.0 -

I used to work for a fast food chain and we had one of our head offices above the 'fried chicken' fast food brand.
Every morning I would walk upstairs, cover my nose and mouth, open the door and run to open all the windows because the 'oil' smell had pregnated the room.
Incidentally the factory where they prepared the chicken was worse. You gladly wore one of those masks and got the hell out of there as fast as possible.
I no longer eat chicken .... nor red meat0
