I am currently in a DMP with all my creditors, i have a wageday loan with a company, they sent my account to a debt collecting agency called DRS, and i have been paying them £5.00 a week. This week I have received a letter stating i need to contact them otherwise a collector will be calling on me on 17-8-10 between 8am-8pm. I am worried sick about this as i will be at work and my two teenage children will be at home and i dont want them harrassed about this. Shall i call them, if i do what shall i say, i dont want to be talked into something i cant afford. Any advice please, i would be really grateful

please......has anyone got any advice, i am really worried about this...they are open today, shall i call them?0

Not sure but if they did you cant pay them what you dont have sometimes they are just letters or threats but they dont always carry out what they say and you are already on a DMP0

Thanks for your reply, i might pluck up courage later, and call and say i am on a DMP and cant afford anything else, i just dont want them turning up at my door whilst i am at work harressing my children:mad:0

Thats ok but dont let them bully on the telephone you have a DMP in place so tell them there is no need to call this has been agreed and you are paying the agreed amount assuming you have not missed any payments and hang up0

Thanks for your advice, i have not missed a payment0

I'm not sure either but if you are on a DMP already is this part of the DMP and if so could the DMP company intervene on your behalf?
If it's not part of the DMP - could it be added in?
If you are already making regular payments of what you can afford your are already doing the best you can
The general advice on here is usually not to phone people, do everything in writing so you cannot be bullied or misquoted. Also, as I think somebody else said, the collection visit sounds more like a scare tactic than anything else (I started with £28k of debt and have had several such letters but never any visits before I starting to make regular payments to all my creditors)

Thanks for your advice Shoe Gal, i was getting myself in a state, thinking of me at work and some stranger harassing (sorry about the spelling), my children on my doorstep!0

i agree with Shoe Gal but for peace of mind you could amend this letter to suit yourself and send it to them, i know its a bit late to post now but if your quick on monday it may be possible for it to arrive on tuesday morning or if possible email it to them. otherwise send it off anyway to prevent any future visits.

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.
Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.
There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).
Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.
Yours faithfully,0 -
You could try sending them this letter....
http://forums.moneysavingexpert.com/showpost.html?p=33792303&postcount=38
which basically denies them the right of a "doorstep visit"
Send it by recorded delivery so that you can be sure that they receive it, it should reach them before the 17th. And don't panic, DCA's have no right to take any goods, they just come round to try to make you increase your payments, which is frowned upon when you are on a DMP as all your creditors are paid on a pro-rata basis. They'll just have to wait for their money like everyone else!
