Sales of Goods Act - 28 days

I have given a camcorder in for a repair, I understand as part of the Sales of Goods Act (SOGA) that te items needs to be repaired and returned within 28 days.

When the law says 28 days does it refer to 28 working days or is it 28 days from when it was given in?

Anyone can point me to this part of the act as i've googled it and all I can find is the reference to 28 days :(

    Where did you get 28 days from? Although i dont know the SOGA word for word, i was under the impression it is simply within "reasonable" time but doesnt define what is "reasonable".

    (2)If the buyer requires the seller to repair or replace the goods, the seller must—
    (a)repair or, as the case may be, replace the goods within a reasonable time but without causing significant inconvenience to the buyer;

    In SOGA you are correct it does say product needs to be repaired within a reasonable time. Any ideas what is reasonable time?

    I did google it somewhere where it stated 28 days is reasonable although it was not specific to SOGA.

    Who did you return it to? The manufacturer or the retailer? What was the fault with it? What have the retailer said?

    The problem with the camcorder is one side of the shutter doesn't close, it opens fine and I can use a finger to close the shutter. But since I had the camcorder for 2 months I wanted it repaired.

    I returned the item in store to Currys on the 1st August. (Initially they never wanted to deal with the matter but told them under SOGA they are liable as it was purchased from them. They were initially telling me that they only deal with matters for the first 28 days of purchases after that go to the maufacturer)

    I guess it would have been quicker if I got in touch with the manufacter but the reason it was given in store is I used up my annual leave and can't take a day off work so it was convenient for me to drop it off at Currys and for them to deal with the matters.

    I did speak to one of the managers at Currys and he did say 28 days but I thought it was defined in law somewhere whether it was working days.

    I think you are confusing the ability to reject the item for a full refund within a reasonable period and the time a seller has to carry out a remedy under the SOGA. "Reasonable time" is not quantified in the SOGA and all depends on the item in question and the circumstances of its purchase. As far as carrying out the remedy of repair then they can take as long as they like so long as it doesn't cause a "significant inconvenience".

    As mentioned above it is not 28 days, it is a "reasonable" period.

    Take your own guess as to what that is!?

  • In regards to Currys and their 28 day policy.

    Basically it's 28 days from the day they get it (pick it up/get it in shop). More importantly, 28 calendar days (not working days).

    However after experience and reading some other information, you will probably get it back on the 13th or 14th day and nothing will have been solved. So now the onus is on you to get it back to them ASAP (that day or the next day) as when it goes back.. the 28 day policy will continue until the 28 days has lapsed.

    Who made the camcorder? If Samsung, their repair service is really quick at the moment. (about 7 days at repair + 3/4 working days for transit)
    Panasonic - also very quick, but arranging to pay for postage can delay it (about 3 days at repair + however long to transit)
    Canon and Sony, I'm not sure of, as I've not booked in any of their products for a long while

    Its a JVC camcorder.

    Went to the Currys branch today and it hasn't even been picked up for repair :(

    Surprised that its been 2 weeks and just sitting in the Currys branch. I'm going to give them another 2-3 weeks and then hopefylly get a replacement or refund as I need a camcorder for 2nd week of September, family wedding.

    Looks like if I get a replacement its not going to be a JVC if they that bad or probably won't be buying from Currys if there at fault.
