  • The Main facts are as follows;
    1. Towards the end of an existing contract with 3, I was contacted about a new deal for me. my then existing one had been a 12 month one. It was a very good deal.
    2. I agreed this new 18 month one with strings attached. Amongst other things I was entitled to a £5 a month loyalty discount, plenty mins and texts and a new phone
    3. I wasn't given my £5.00 discount from the begining. This wasn't the major issue. The major issue was
    4. that I was entitled to receive free msn messenger or yahoo messenger on my phone. Sadly, it turned out this phone wasn't YM compatible but msn messenger compatible.
    5. 3 disputed this when I drew their attention to it. initially, they said I should have returned the phone during the 14 day cooling off period (I contacted them after realising YM was not possible and this was just after the 14 day cooling off period)
    6. I argued that I had no problem with the phone itself - SADFART matters here. My main argument was that the phone came with a list of services I should enjoy and that onthis particular point (YM), the phone was failing.
    7. So 22 months ago I started this long journey of seeking redress. First phone calls, then emails and recorded letters to 3. then the rather toothless OTELO - The telecoms ombudsman, then online small claims to county court
    8. They were found at fault on all matters - huge delight. Ive got a big story for my students in a few weeks about how I spent my summer break!!

    In summary, the phone did not do something they claimed it did?
