Hi, I parked at Robin Park in a disbaled bay this morning.
As it was early there were very few cars on the car park i parked close by to the shop i was visiting and simply forgot to display my blue badge. The car park was virtualy empty and there were loads of disabled parking spaces, i have never had any problems here before. The notice is for 'not displaying valid id disabled badge' and they have taken 4 photos. Having read through the threads regarding this company, my initial reaction is to ignore it, but as they have photographic evidence of me in a disabled bay without displaying my badge, am I right to ignore it. Any advice would be appreciated, thanks

Just ignore them, you are entitled to be there. You owe them nothing. Continue to ignore them even through the 5 or 6 threatening letters.

CMS are a two-bit outfit running out of Lytham.

Simply ignore them. Expect letters from Roxburghe and Graham White.

Collect the full set, put in an envelope and give it to the little man in the portakabin next to Burger King. Write "you are wasting your life giving out fake tickets" in big letters on it.
  • I did exactly the same yesterday. I was down there at 9.30am, and I was looking for a parent and child space near the shop I was going to. They were all full, so I parked next to them, not even thinking that I was parking in a disabled space.

I literally nipped in the shop, bought my 2 year old a chocolate lolly, and then returned to my car. It must have been less than 2 minutes. I didn't notice the ticket until I got home and parked up. I am fuming, both at my stupidity, but more so the fact that they obviously 'hawked' me.

It states on the ticket that they have taken 4 photo's. (But that seems to be questionable, given how quick I was in and out of the shop) If so, I am bang to rights. However, I have been looking on here and other forums, and consensus of opinion is don't pay.

I've not long settled a six year old identity fraud against my name, which saw me hounded by several debt recovery companies. I'm not sure I have the stomach to sit it out whilst another company, and or a solicitor start to send threatening letters. Am I going to just end up delaying it, and then get taken to court and found guilty, leaving me with a big payment to make? Am I not just better paying them, preferably in instalments of say, £5 a week. I have already been told that they will allow me to do this.

A footnote to this is that I am NOT THE REGISTERED KEEPER OF THE CAR. That is my wife. She knows all about this (great way of finding extended married harmony...not. "I honey....I've got a parking ticket")
I have studied the ticket thoroughly, looking for a technucality on how they have worded it, in comparison to British parking Association 'code of practice', but I can't find anything to get them on.
Fact is, I WAS guilty of what they say (parking in a disabled space). I know that. My gripe is that the charge of £80 or £50 paid within 14 days is very steep, considering the B.P.A. say that a charge should 'not be over £75'. (I have been told that if 'a payment' is made within 14 days, I will only have to pay £50 (in instalments)

    So what SHOULD I do?

Is delaying payment just going to come back and smack me in the face? or should I just ignore anything from them, or even have my wife send a 'Not The Driver' letter, from the template on this site?

    Please help!!!!

Even if they have photos, they prove nothing.

No one gets "Found Guilty" in a civil court. Not that it matters because CMS don't do court anyway.

    NO NO NO NO NO!

As RK, your wife will receive loads of threatening rubbish through the post. Tell her to ignore it.

I have studied the ticket thoroughly, looking for a technucality on how they have worded it, in comparison to British parking Association 'code of practice', but I can't find anything to get them on.
The BPA is not an official body, it is just a club run by the parking companies for their own ends. You don't need any "technicalities".

Fact is, I WAS guilty of what they say (parking in a disabled space). I know that.
Disabled bays have no legal standing in a private car park. Like "parent & child" bays they are no more than paint on the tarmac. You have done nothing illegal.

My gripe is that the charge of £80 or £50 paid within 14 days is very steep, considering the B.P.A. say that a charge should 'not be over £75'. (I have been told that if 'a payment' is made within 14 days, I will only have to pay £50 (in instalments)
You do not owe them a penny. The BPA "rules" mean nothing.

    So what SHOULD I do?
    IGNORE.

Is delaying payment just going to come back and smack me in the face? No.
or should I just ignore anything from them, Yes
or even have my wife send a 'Not The Driver' letter, from the template on this site? No. Do not contact them at all, it only encourages them to send out more tat.

    Please help!!!!

Hope the above helps. Read everything you can find on this board about the private parking scam, and stop worrying.
Its interesting that they are offering instalments - wonder if they have a consumer credit licence?
