Pipex Dial bought out by Talk Talk(Opal) but account balance not transferred. Advice?

My OH has a Pipex Dial small business account which he pays annually in advance. He last paid on 10th May 2010, to cover year June 2010-2011. On 1 June 2010 Pipex Dial became part of Talk Talk as Opal. The Opal website says there will be no change in Ts+Cs for existing Pipex customers.
However he has just received an invoice from Opal for the first quarter from 1 June -28 August. He phoned them up to point out he had already paid for the entire year (and has proof of this) but they say they have received no records of his payment from Pipex and therefore cannot credit him. In any case they do not offer an annual prepayment option.
Anyone else in a similar position or know what the legal position is?

When they bought Pipex, they bought the company's liabilities as well as its assets. The fact that they have not got their act together in terms of their internal records is their problem not his.
If he has documented proof that he has already paid for service not yet provided, I would write to them threatening legal action if they do not honour the contract. I would also state an intention to seek compensation for any further time wasted in trying to resolve a problem that they have caused.0
