Threatening letters from creditors

Are there any rules about threatening/intimidating letters from creditors? I have an arrangement with a creditor which I have kept to religiously. However, they have started bombarding me with letters saying I agreed to increase my monthly payment (I didn't as I can't afford to) and have therefore defaulted on my agreement with them. I'm fairly sure they can't threaten me with legal action if I've kept to my agreement, can they? Does anyone know of any rules/regs I can quote to company in a letter? Any help appreciated, thanks.

  • Hi Chocky,

I have arrangements and every six months they contact me asking for an increase on my payments. In my experience, they usually only expect a small increase as a goodwill gesture of £5 which has been no problem with me as I have been in the position to increase. However if you can't increase just resend in your SOA to the company showing you can't afford anymore and there is nothing they can do about it. My advice is to keep talking to them and always let them know your situation. If you ignore them then thats when it gets difficult.

    Hope it sorts itself out!

If you write to them, explain your situation in that you have NOT agreed to any increase in payment, nor can you afford to increase payment, then the letters should stop. If they continue, especially if they continue to make statements which are obviously untrue, then, in my opinion, this could be construed as harrassment, and should be referred to the Office of Fair Trading.

If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
