Credit rating/Defaults/CCJ problems

Hey, I recently tried applying for a loan for a car and was turned down, which shocked me, so I decided to check my credit rating. Instantly I notice it states I have defaulted on two things I have never even had, which are listed below:
Also, I found I had a ccj issued in 2008, of which I had no idea. It was from UNITE accomodation in leeds, as I was there for a week before having to leave due to medical issues, and discussed it with them and was allowed to go, as I had already paid 4 months in advance. It seems they then decided I wasnt good to go and got solicitors involved and issued court proceedings with Northampton CCBC. As I said I was not notified about this, though apparantly my mother was (she was jointly named on the unite thing), so I rang the courts to find out more and was told it was made by Lees Whitley, who have since gone bankrupt. I dispute that the ccj should have been made in the first place as I never got the chance to give my side of it, and now I find out the creditor/solicitors doesnt exist any more so even if I wanted to pay off the debt I couldn't.
Any advice for a stressed out person?

For what it's worth, I have just checked the T&C for Unite and can't find any mention of having to pay for the room if I am not actually living there anymore, it also states that if it is not paid, the landlord ie unite can get a court order to nullify the contract as if it never existed. If anything they owe me money!

Hi, can't help directly cos I'm not an expert on credit records (plenty of people here who are). I think the first step is to contact the companies and ask them to provide a signed credit agreement if they can't then the debt isn't enforceable and should be taken off. If they can provide one then you can start disputing anything on it that doesn't look right.
Not sure about the Unite thing, doesn't sound right. Maybe get in touch with them and talk it through?
Good luckI'm a qualified accountant but please make sure you get expert advice as any opinion is made in a private capacity.

Thanks. I have contacted Orange by email as I couldnt get through to them over the phone thanks to a lack of a orange mobile number. I have no contact information for Lowell though, and no idea who the debt is for or any references, so that one could be difficult.
As for the Unite thing, I have again contacted the court so just waiting for a reply. I spoke to someone from the insolvancy helpline who said I probably dont have much chance seeing the claimant solicitor went bankrupt, unless I could get hold of the t&c's, which I obviously have, so will see. It is just annoying though because if nothing happens then I have another 4 years worth of bad credit for stuff that a) I never signed for or B ) I was wrongly ccj'd with

I would have a word with the credit reference agencies and ask them to confirm these accounts are actually yours and have not been added by mistake, given that you do not recognise these accounts.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Orange do have a company rep you could talk to on here -Orange_Company_Representative wrote: »Hi,
I work for Orange and may be able to help. If you can drop me a mail to the email address in my profile, I'll have a look at this for you. So I can pick up your mail quickly, please add 'Andy Orange Response' in the first line.
Please also include the reference ORT1015, your username from this site and some account details, as without them, I will not be able to pick the case up.
Hope this helps

Yes
Rasie a query with the credit reference agencies first, if they appear to be wrong, in the short-term add a note to your file.
Then send a prove it letter to Lowell and ask orange to prove the debt is yours.
Pity your mother did not mention the CCJ, as you could have had it set aside. get hold of Unite and argue your corner. If you've have not made a mistake, you've made nothing0 -
Cheers guys, I will get on it after work tomorrow and see what they all say.0

As for the Unite thing, the court has instructed me to apply for it to be set aside and heard in my local county court, at a cost of £75. I will do it though I am just wondering how the otherside will as Unite have stated they sold the debt to that solicitors and the solicitors are now bankrupt, so surely the court wont be able to get in touch with that side of things?0 -

Here's some info in getting a CCJ set aside-

If the other party no longer exists I would imagine this would strengthen your position as they would not appear in front of the judge for the hearing and so rule in your favour.
Good luck with it all!
