Buyer unwilling to pay - and I agree!!! Help!

Basically I auctioned a mobile phone on ebay. The listing clearly stated 'NO bids from anyone with less than a rating of 10 unless the emailed me first'
Typically with 10 mins to go - a zero rreated bidder that had registered on that day bid on my auction and outbid the previous bidder!
I managed to cancell all his/her bids & block him befor ethe auction ended.
Ive now recevd an email from the winner of the auction to say that as soon as he was outbid, he bid elsewhere and won another auction.
Now - how do I proceed from here?
Ebay have taken their cut from the £99 winning bid - how do I get may final selling fees back without droppin the winner in it? Can I get my fees back and not run the risk of being negatively rated???
I hate these scammers that ruin so many of my auctions!
