Terms and conditions V Distance selling regs

Good morning all,

Please be aware of the following two companies who both sell via the web on their own sites and Amazon.

Jileon Ltd and Sockshop

I have recently used both companies to purchase items and I must admit that the service, price and delivery times were more than acceptable.
However the terms and conditions on both sites do not comply with the Consumer Protection (Distance Selling) Regulations 2000 (as amended 2005).
I have emailed both and am awaiting a reply

    This is very common and i find that if i ever need to return something i send an email and attach a cover note laying out the regulations just to protect myself. Nobody but TS will get them to change it though.
    Back by no demand whatsoever.

    unholyangel, sorry for not replying sooner but to see the extent of their illegal terms and conditions you woould need to visit their respective sites.

    However an update is that neither company responded to my emails to them so I forwarded details to their respective trading standards office, Bolton for Sockshop and Leicester for Jileon, I had responses from trading standards agreeing that the terms and conditions were illegal and did not comply with the Distance Selling Regs.
    Both companires will be advised to change their T&C's in due course.

    Seems they have already done so..as far as I can see nothing it outside the DSR; apart from maybe their saying that "returns" must be sent back at the buyers cost, not distinguishing between change of mind and faulty returns. Oh, and
    If an order is cancelled once payment has been made, a £2.50 administration fee will be deducted from the refund.
    The more I read, the more I see nothing's changed, so my first sentence is wrong here. :D

    Also, this just confused me:
    All of our products come with a 180 day guarantee against defects, please note that any defects that occur outside of 180 days are no longer our responsibility.

    Please note that all defects must be reported to us in writing within 7 days of purchase.
    Ignoring the SoGA-exploding "defects occuring outside of 180 days are not our problem", what use is a 180 day guarantee if you have to report it within 7 days of purchase?

    Let the company employees deal with terms OP, Instead of going out of your way to find a fault and complain. As you said its more than acceptable why even bother to make an issue with terms.

    That bit is compliant with the DSRs.

    I do think the OP has a wee bit too much time on their hands.

    Sorry, Cyberbob, reading my post back, it wasn't clear - but I meant they don't say it's just change-of-mind returns, leaving the way open for (potentially) charging customers to return faulty goods.
