Tuped and Holiday Allowance & Annualised hours

Hi

I work for a company that has lost a contract servicing a restaraunt chain and the 56 staff that work on the contract are being Tuped however the company that is taking over the supply is locating the distrubtion centres over 100 miles from were we are based so it is unlikely that any of us will be actually being transfered but we are expecting to be made redundant.

If we are made redundant by the company that we are tuped to can they use any outstanding holiday allowance as part of the notice period ?

Also we work on a Annualised hours system which means that we dont get paid for an extra hours that we have worked but they roll over each week and should balance out over the course of the year (some overtime, some early finishes ) but with the contract ending in the middle of next month a lot of us have built up a balance of 40 extra hours or more we have been told that the company we are being tuped to have to sort the payment for these hours but again can the be used but the company we have transfered to as part of the notice period ?

    I think you will find they can chose to use the accumulated hours and holidays during the notice period.

    The annualized hours are exactly for this type of situation where you are under contract but no work.

    Does the contract have a minimum hours or is it fully flexable over the year? that should make a difference to how many hours they can use up.

    Holiday has always been at the discretion on the company.

    I would be watching the calculations very closely based on the contract and custom and practice, there may be different interpretations of the implimentation.

    If all 56 are likely to go there will need to be consultaton.
  • Thank for your reply the hours are fully flexible so it looks like that they will wipe out all of the hours to kill some of the notuce peiod then !!!
    We have all ready been told we are in danger of redunancy and the company we are transfering to are trying to start consulaton prior to the transfer date ?
