Julipa returns problem – please help!

I ordered 9 items from Julipa (clothes). I returned them late (after 28 days) due to different reasons. They charged me a late return fee of £3 per item which I am willing to accept since I was over the 28 days and they still accepted the return (T&C say if they do there will be a 3£ charge although I don’t remember it said per item on the back of the delivery note, but it does on their website!). But they also say that the value of the late returned and credited items has to be spent on a new order within 6 months. I don’t intend to ever order anything again from them. They also did that in the past, keeping all my money of the (in time) returned items without crediting it back to the credit card and as I hadn’t checked I found out only a lot later (it was sitting in my Julipa account).

Do they have the right to keep my money if I don’t want to ever order again from them? We’re talking £200. They’ve already accepted the returns and charged me a late fee.

    You were burnt once and didn't learn? If you had contacted them within 7 days of receipt and let them know you were returning the items you should have got all your money back. (excl. return postage). Their T&C's say £3.00/item and a credit note.

    Consumer rights allow you to return under DSR if you notify them (dont actually have to send the items at this point) within 7 working days of receiving the goods that you intend to return them.

    If you did not do this then unfortunately you are subject to their T&C's. However, it is possible (although someone may have a better idea) that it could constitute a unfair contract term that you will lose the funds if not spent in x long.

    If you really arent going to order from them again you could try contacting your card company (if this is how you paid).

    Or, if anyone has a birthday coming up.......maybe get them a present/do some xmas shopping?

    I don't have a better idea but my feeling is this probably wouldn't be the case (some credit notes/gift card refunds I have had indeed had expiry dates on them). I think if the time period was unreasonable (7 days or something) then you could argue strongly against it but the 6 months in which to spend it seems quite fair.

    I'd go along with Unholy's good advice and just use it to buy presents with for Christmas, you could be fighting a losing battle with this one.
