If the work is currently in progress, and no Party Wall Notice has been served, then go straight to a solicitor and get an injunction to stop the work straight-away
This will be granted by the court within a few days. Best of all, the neighbour will have to foot all your legal costs, and then the costs of engaging party wall surveyors to deal with the Act.
Massive, massive costs for him.
Then, within the Party Wall Act award, get the position of the wall recognised or moved back to the boundary.
Alternatively, send the neighbour a recorded delivery letter giving him ten days to remove his property (ie the wall and foundations etc) from your land, failing which you will remove it and recover your costs from him in the county court. Then dismantle the wall0 -
