in Credit cards
I am posting this on behalf of a friend so I don't have exact figures.
A while back my friend used this company (myclaimsexpert.com) to reclaim unfair credit card charges.
Her debt to the card is in the hands of a debt collector.
Recently she received a letter telling her that she had won the case against the bank and that they offered around £1,100.
That's great she thought, my debt is now down a fair bit.
A short while later she received another letter telling her that she owed them £700.
After a call to them it transpired that because the card was now in the hands of a debt collector that the whole £1,100 taken off her debt and that she was liable to pay the bill for their services. After another call they said that they could set up a payment plan for her to clear the fees owed.
At the moment she is paying as much as she can to existing debt and can't afford to pay out anymore money.
Basically she is worse off now than she was before. Fair enough her initial card debt is down but she now has a fresh, new and shiny £700 debt that she cannot afford to pay.
Legally how does she stand with this? She was told that her fees to the company would be taken from any successful claim.
Is she liable for the fees or should they have come off the settlement from the bank before it was handed to the debt collector?

These weasels (Stuart appears to be the only one who works at MyClaimsExpert) are trying the same trick with me. After recovering around £390 for me, they are claiming charge for £400+ which doing the math simply doesn't tally especially since they quoted that they pay 90% of the claim. So I asked them to provide proof and figures. The lame excuse is that they claimed 'interest' on the original amount of late fees that the card company paid to me (£100). I pointed out to them that I have not requested 'interest' and basically they can stuff it. Getting letters from them every month now saying they will have to take 'legal' action. Anyone else getting the same treatment from MyClaimsExpert?0
