Hi all
I've just had a letter from a financial company demanding that i pay off my student loan - which thankfully only totals £1,000 - all in one go.
I had an arrangement with the student loans company that i would pay them £12 a month. Then i got a letter from the new company Thesis, saying that i didn't have to pay back the £12.
I have been dealing with two major shocks in my life this year, a bereavement being one of them...so when i got this letter i didn't deal with it. I noticed that on my bank statements the money that i sent the student loans company was being returned back into my account. I thought maybe they were just allowing me to defer after all....
Now i have a financial company contacting me, saying i have to pay back the amount in full or be taken to court. They asked me if i could get credit to pay the amount back I said i can't get credit because of the CCJ i had in the past, from the student loans company (my own fault, I didn't fill out the deferral form and have been paying for that mistake since). They said there's always a way to get credit - i don't know of any......
What bugs me is i've done my best to clean up my credit rating and they are likely to be damaging it again now.
Thoughts? Experience? Advice?

Hi, I think for some fuller advice you might need to pad out the circumstances slightly.
I'm sure that asking you to obtain credit to pay-off existing debt is already a breach of OFT guidance for debt collectors, someone will confirm.

I am in a position to make payments and was making them regularly - with a standing order. Then the standing order was being returned by the student loans company (following a letter by thesis servicing stating that i didn't have to pay it anymore)......I didn't question this due to other pressures that have been taking place recently.
Now the finance company is saying that due to me breaching the contract back in 2001 they can review the situation with me at any time and that this is stated in writing. Unfortunately i don't have a copy as I wasn't very good handling all these things back then (not like now). The breach would have been failing to make some sort of payment on a due date no doubt.
What i don't understand is why thesis didn't write to me again to review the situation if that's what they wanted? why write one letter saying i don't have to pay and then referring me onto a financial company intent on getting the full amount back?

I'm sure if you can provide evidence that this is a misunderstanding - i.e returned payments and letters, then you're a good way to start paying again and making things fine.
Its very easy to ignore letters (I found/find it very easy!) and let things spiral but I think you've got a good case on what you've stated.
When you say 'financial company' - do you mean debt collectors? (you can say it!):eek:
I would go back to the actual student loan company with your 'evidence' and ask them to call the dogs off.

well they call themselves a financial company - lol!
I just called Thesis Servicing and tried to explain that there was a misunderstanding over the letter. That in the first paragraph it said i was under no obligation to pay...........but later on it said that i could change my direct debit details to ensure that the money gets to them....but it was the way it was all worded (i got the impression at the time that they were still receiving my money, just indirectly via the student loans company) - so i thought i'd just let the standing orders continue.
My father passed away 2 months later so i've been in a mess since then, anything i might have reviewed didn't happen. My father hadn't been ill, it was sudden, unexpected and happened while i was present. I was then faced with dealing with my father's affairs.
Anyway just spoke to a man and he said i need to call the other company. I told him that they had said i could call then, to see why they'd passed me onto them. He said he didn't know why and coudln't do anything else and goodbye.
Then i look at the letter and the manager of both companies has the same name - so it's the same company....
anyway my best bet is to write to the manager because the staff taking the calls seem to be saying that there's nothing they can do even though there's been a misunderstanding, they still want the full amount.
I haven't got the full amount and i've no idea where to get the finance for it when i have a CCJ with the student loans company - all be it an old one..:(0 -

the thing is i've just written to them, I will send tomorrow and see whether they will help when they look at how the misunderstanding occurred.
I've written to the manager.
thoughts on that?
anyone know more on the oft rules re suggesting that i take out a loan to pay them?0 -

Well could help, that way people here would know what to do knowing who is it.
They suggesting taking a loan to pay them, do not sounds very professional.0 -

Put their name on the search area at the top of this page, then click on search on the forum, if their name appears on this site, then you will see that is not a big deal naming them0 -
