Personal Injury Claim

Hi,

My friend was in a car accident this week. It was her fault. This morning she got through the post a letter from a Solicitors saying their client (the person she crashed into) was suing for Whiplash and Lower Back Pain. They said she should acknowledge the letter and forward it to her Insurance COmpany. She has many questions?

1.Who is being sued, her or her insurance company - she has thrid party F&T, will her policy cover this type of claim?

2.If it is the insurance company, will tehy pass on the costs to her, either in lump sum or increased premium?

3.Should she contact the insurance company, and say that the other driver was fine when she left the scene of the accident?

    Hi - Technically the claim is being made against your friend but her insurance company will deal with it and pay everything on her behalf.She will not have to pay anything towards the injury claim as that is why she pays insurance premiums.Her own premium might go up at the next renewal due to the loss of her NCD.As for the whiplash injury informed medical opinion accepts and agrees that it can take several hours or longer for the symptoms to be fully evident.The insurance company will always insist and having a medical examination carried out and will not pay out until they see a proper doctors report.
