Can i get a refund - 3 weeks over the year

I bought an LCD tv from tesco last july at a cost of £250, the picture has just suddenly gone alltogether and theres just a black screen with a red line down it.

I've got the reciept, but it is three weeks over the year, does anyone know where i stand on this? am i still able to take it back for a refund.

It's only used in a bedroom so hasn't even been used that much, but you expect a telly to last longer than a year.

I work for asda and i know that they do honor electricals for an extra month, does anyone know if tesco does?

    Why not ask Tesco themselves and see what they say?

    Also wouldn't it have been easier/cheaper to buy a TV from Asda with your staff discount?

    Ask at Tesco's in the first instance.

    Next step would be the Sale of Goods Act, basically this covers you for up to 6 years for 'inherent' faults (eg. faulty manufacture). If an item is over 6 months old then you need to prove any fault is 'inherent'. This is usually done by commissioning an independent report which you will need to pay for. If the report is in your favour you can present it to Tesco as evidence, ask to claim under SoGA and receive a (partial) refund/repair/replacement (up to them) and a refund of the report cost. The Small Claims Court will enforce this right if required.

    However, be aware without a properly report the TV could have failed for a number of reasons not all of which are inherent and thus claimable (wear and tear, damage like moisture etc).

    Always seek to resolve with the retailer first!

    Call the electrical goods helpline, they will either tell you to take it back to the store or send you a form to complete. They will usually offer you a proportionate refund.

    Under soga. Your contract is with Tescos and not the manufacture. An item must last a reasonable time perdiod but is not set down in law with a maximum limit of 6 year. (Personal i think a Tv should last the full 6 years but that's just a personal opinion and would down to a judge to decide).

    As its been over 6 months it down to you as the consumer to prove the fault is inherent to the item, so its down to you get a independent engineers reporting stateing that the fault is though a manufacturing fault and not fair ware a tear, You can claim the cost back if it find in your favour.

    The option available are repair/replacement/refund but to all intents a purposes its the shop that decided. (its a it more complicated than that but its late)

    They can devalue your Tv taking a proportion of the item expected life time to that maximum of a 6 years ie

    If you tv cost £1000 and a court agreed that the tv should last for a least 6 year you'd now be entiled to ~£833

    Do as above poster says and ask Tesco first be polite and pleasant but aware of rights don't go in there demanding fashion it just put the backs up the employees and manger and makes them less likely to help you.


    There's always the secret European law but I would have to kill you if I was to tell you about it its that secret. ;-)

    Yeah wish i did now, would of been so much easier, but they were on offer in tesco at the time so got it from there.

    I'll ring tesco tomorrow and hopefully they'll honor it. Thanks everyone for the advice.

    As mentioned above be decent about it with the staff and you should get somewhere with them hopefully.

    Do you still have the receipt then?

    If you're going in without a receipt anyway then I don't suppose it would hurt your case to say you bought it less then a year ago.
  • Wasted my time as OP posted this thread yet again even though they read this thread unbelievable

    Maybe they like one of us to take tv back to shop too saves getting off there backside or even using google to search for there rights

    Theres no need to take that tone! Yes been new to this forum i posted it elsewhere, but then realised i should of posted it in this section, so reposted.

    I did google it first, but though someone might of had a similar experience on here that could help me. Nothing wrong with that!
