Counterfeit or Fraud or both

Whilst on holiday recently we purchased a video camera and thought we were getting the latest up to date model. It was only on our return from holiday that we found out that it wasn't. We are trying to have our credit card company investigate as to whether we were fraudulently conned and if the camera is a counterfeit. I think we were scammed as the camera on the internet is only worth about £50 and we were charged over £400. Do you think we have a case and has anyone else been duped like this?

If it's counterfeit, i.e. claiming to be a Sony but actually not a Sony you may have some mileage here.

If its just the case that it's not as up to date as you hoped, that's just a case of not doing your research unfortunately.
  • I wish you good luck but i'm not liking your chances to be honest.

For instance, even though you were on holiday you still should have known the value of what you were buying (research). A store in theory can charge whatever it wants. For example if you were in a remote town, with no competition then the video camera may be priced at £400 because there is no other way of getting one. It also may be the "latest model" to that store but no necessary in a big city etc.

I don't want to be nasty but if you paid £400 you should have know what you were buying (model number etc) and done a quick check on a internet cafe before you paid. Sounds like you may have been charmed over by an enthusiastic sales man abroad? Its their word against yours and because you had chance to inspect the goods before paying I think its unlikely you will get a refund. Sorry but good luck. :(

    Depends what's on your receipt.

    This is a good example

I buy a Gold Ring from X place

I come home and it's not a Gold Ring at all (after being independantly assessed)

    On the receipt it shows

"Gold Style ring"-Here would have no recourse
Gold Ring-Here I would have recourse against merchant.

However what you will have to do is get it independantly assessed and this report would need to be sent to the credit card company.
