Capital One Direct Debit problem

OH has a problem with Capital One which has come to light today.
Direct Debit for the minimum payment was due on 2nd August. He switched instructions from A&L to his new Barclays account at the end of July and thought everything was fine.
On Tuesday, C1 took the DD from his account on schedule. Today, he gets a letter in the post from Capital One stating that the DD had failed.
Logging on to his account he sees that they have charged him £12 for the failed DD and another £12 for putting the account over limit.
Checking Barclays online, it does show the DD coming out on 2nd Aug, but on 3rd Aug it is returned unpaid, despite being more than enough (by hundreds) in the account.
On phoning Barclays, they've told him they refused to pay the DD as Cap 1 had not sought permission to collect the DD, they just did (i.e. the 10 working days required to set up a new instruction.)
Capital One aren't interested, saying he needs to phone their payments department Mon-Fri between 9-5.
Am I right in thinking this is entirely Cap1's fault and they should refund the £24? They should have notified him that there wasn't sufficient time to set up the DD and he should have paid by card this month. Instead, they confirmed payment was by DD from the new account and indeed tried to take the payment, but was refused.

I too have trouble with capital one and DD they never take it and in 4 months have had 3 missed payment charges! I gave up with C1 and DDs as they were returning DDs for no reason then charging me, I think I let it happen twice then I changed to manual payment as soon as my statement came in every month.
Good luck getting the charges back, I managed to get one lot of charges back but they refused the second time round.Debt Free...yay! 10/09/2013 :j

This is more about Barclays refusing the DD on the grounds that they were not properly notified of the new instruction. C1 just took the money on the due date.
He phoned C1 again this morning and they failed to grasp this concept at all, saying that since he had set up the DD with them that was all they needed.
I'm pretty sure they need to set up an instruction with the Bank *before* they are allowed to apply for payment.
Does anyone know the correct terminology for this so when he calls C1 again tomorrow they might have a clue what he'll be going on about?Remember this: nothing worth doing is easy.0
