Apple - iTunes - apps ... refund?

I've seen Apple's policy - straight out no refund.
My automatic response is surely this is not allowed, but knowing my luck, the answer will be that it is.
Just wondering about my case:
I bought an app for the iPhone - a GinRummy game. Ok it only cost 59p, but it doesn't work (if you're thinking is that all, then read on to the next app)...
I went into my purchase history the other day & reported the problem, app not as expected, and asked politely for a refund. No reply since then, so i went through the main Apple website today.
Onto the next app...
The main app i wanted was a SatNav one. Heard great things about the TomTom app, so £49.99 later, i had it.
Tried it out on my iPhone, which is a 3GS running the latest software.
It doesn't work!!
I'll be driving along & it'll exit to the main iPhone menu. I'll go back onto my journey & then the map will auto disappear - the app has crashed again.
It keeps doing this.
I've paid for a working app, but i've not got one.
Filled out the report a problem form the other day, but have had no reply. Gone through the main Apple website today to report it.
£49.99 is a bit of money to be spending on something that simply doesn't work.
If i purchase a few more costly apps, you can see how expensive this could potentially get.
Am i totally out of luck? Surely there must be a way as the app doesn't work at all.
Oh & i've tried the app support feature - it's been nearly a week & they can't be bothered replying to me.

Have you tried emailing Apple and/or TomTom? I suggest that first. Using 'report a problem' style links might not be monitored very well. Look at the two websites for a Customer Services email address. That would seem your best bet.
Is your iTunes account funding by credit card? If so then the cc company is held jointly responsible, so your next port of call would be them.0 -

It was my understanding that they're only jointly liable for amounts exceeding £100 as this is legal protection they MUST provide. For anything else, they may be covered but this isnt necessarily a legal entitlement.
However, if it was a visa (credit or debit) and under £100, you could start a chargeback request. I've contacted TomTom by setting up an account with them & going through their help procedure.
They're ignoring me.
I contacted Apple/iTunes first via the report a problem link, but then by the Apple website.
My method of payment was crediting my iTunes account with £50 & then paying for the app that way. It was credited by paying with a Visa Debit.
I guess then that because i paid (for the app) via my iTunes account & not "directly" from my Visa debit card, that i'm out of luck & to pay only via debit/credit card in future?0 -

Might be worth trying the apple store. Take your iphone in, show them the problems youre having, and see if they can give you anything out of good will. Ive heard good stuff about apple store customer service in the past.0
