How can I find the details on a CCJ

Hi

My stepson is in one hell of a mess with his finances so I made him get a credit report.

He has a CCJ from june and he didn't even know anything about it. Can he find out who took him to court and what debt it was ?

He also has 5 other accounts that show defaulted, total 20K. Where do we start ?

    I have got my credit report in front of me and if it is still the same where the CCJ is listed it should also list the court where the judgement was granted, the case number and the source is the person/company who took it to court.

    Give the court a ring on Monday, they probably don't open on Saturdays. It is likely that the judgement was granted in default as your step-son did not reply. Unless your step son completed an income/expenditure then it is likely that full payment was required within 28 days. If the issuing company does not receive any contact they will eventually ask for a court bailiff to visit as he is in default to the court. I think it is N245 to ask for bailiff to not call and on this form you can ask for a reduction in payment. Give them a call and explain the circumstances. They may say that he can apply for it to be set aside but if he owes the money it is probably not worth it.

    With regard to defaults and all other accounts there will be some people (as a general consensus, not implying that the people on this board would think like that) that say ignore the accounts unless you get letters but I would say (as a Money Adviser) that for your step son to address his spending he should deal with these head on.

    Has he got any letters at all? If not try contacting the companies listed on the file and getting the issue addressed.

    As you may already know defaults are issued when you break the terms and conditions of an agreement, so I assume your step son had not been paying for a while.

    He may owe other accounts other than the ones that show as a default but maybe the companies have not got round to doing anything about it.
    Listed on the credit file is a list of credit information and that will show which accounts are open.

    I think you need to find out as much info as possible about the debts and then help him draw up a financial statement and then go from there. If you feel able to help him he may be able to set arrangements with all his creditors but if they want more than he can afford maybe consider Payplan or CCCS.

    For info - did he just apply to one credit agency or both as some financial institutions only report to one and not both so the info may be misleading.

  • Thanks for the advice, the CCJ was in June so how long before baliffs appear ?

    He has moved around quite a bit and I think, will they be able to trace him ? He has a young baby and partner at home all day and he doesn't want them turning up while he's at work.

    I can't see him ever being being able to pay these debt's, if he goes bankrupt, will the CCJ also be settled ?
