I used a company called EMS Internet to build me a website. The website they built was below par to say the least so when my first year was up they sent me a letter saying it will be £400 to renew the subscription so I emailed the company to say i would not be renewing, and the website was took off the internet. 3 months later £400 was paid into there bank account because i forgot to cancel the standing order. I rung them and asked them to transfer the money back thinking this would not be a problem, it was mistake. They are refusing to give me the money back even though they are admitting that i have cancelled the subscription and they say they will give me a credit note and build me a website which i dont want them to do. They will not even discuss giving me the money back they just blantently say no we cant give you the money back. How do i go about getting my money back as they have no right to keep my money as they have not done any work for it.

If they won't voluntarily give you the money back, you'll have to sue them.
Be aware that full recovery may not be possible as they could counter claim the cost of accepting the payment and refunding the payment they have incurred (business banking is rarely free) as well as their administrative cost. However, I can't see that amounting to £400."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
