Dear XXXX,
It is with regret that I demand the following action from you.
I contacted you on 07/07/10, and again on the 16/07/10 and 05/08/10 in an attempt to resolve the matter but it seems no action has been taken. I have not received the outlined articles at either of the addresses I provided.
Please take this letter as notice before legal action.
My records show discrepancy following my resignation from XXXX as follows:
• Unlawfully withholding P45 tax form.
• Unlawfully withholding all wage slips.
This is a statutory demand under The Employment Rights Act 1996 section 8 and PAYE Regulations.
Supply me with ALL the information requested, in its entirety.
If the information is not forthcoming or incomplete then I shall force your compliance through an Employment Tribunal, due to breach of the above act.
You have 14 days in which to comply.
Please post it to the address below:

do you still work for them and have you worked over a year because whilst it maybe your right to assert your statutory rights this is most likely a sure fire way to see the door.The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

Oh i worked there for about 6 weeks. Resigned (cause they were horrible)
and they're just withholding those articles. (well they've said they sent them but it's a lie)
Edit: oh and I also think I may be short of a couple of days pay - so definitely would like to see my pay slips0 -

In all honesty i think would completely rewrite your letter, it sounds rather pompous.
Wait a while for other advice before you send anything.make the most of it, we are only here for the weekend.

It comes across as a very angry letter, winding them up could potentially make them dig their heels in even more. When you are feeling calmer try and rewrite it in a much more neutral tone, it is likely to be more effective.0

When I first saw the draft, I thought we were being asked to comment on what the person should do who had received it!
For a start, I don't think that the "unlawful withholding of a P45" is covered by PAYE regulations. If it is, quote where this is stated.
I wouldn't close with a "Yours sincerely", that's much too friendly.
And how did you contact them on the dates you have quoted?0 -
I'm quite calm :P it's not the end of the world.
I just copied this straight from somewhere on the internet. Thought perhaps this would scare them into action.
They're already deliberately being as difficult as possible, cause that's their nature. The Acas people told me to write a letter requesting it, and then if they don't just call them again and force them to send me these articles through a tribunal (not sure what that involves, but I don't think it costs anything and I've got a couple of months to kill before I start something new in October.0 -
Oh and I contacted them by email a few times, and once face to face last thursday. (where they cheerfully told me they'd posted it to the address I'd given them a month ago (knowing I'd now moved out, and having last told me I'd have to turn up to pick them up cause they wont post them). I picked up my post from the old address and know they were just lying about sending it there anyway, I get mail forwarded now.0
