Swarovski Grrrr

Hi all,
My boyfriend bought me a swarovski pendant 2 years ago at the end of this month (the 28th or something). At the beginning of last month I was wearing the pendant as usual when the actual pendant dropped to the floor and i was left with a chain! I picked it up to find that on the part of the pendant where the chain threads through, the metal has fell clean off! I took it back to the retailer it was bought from and because it is still under warranty, I wanted it repaired or replaced as stated. The people in the shop said 'they won't do anything about it it'll be customer damage' but i insisted and they did. This morning I get a phone call telling me that 'unfortunately' (how patronising) it IS classed as customer damage (what a surprise) and nothing will be done. HOW on earth this could be classed as customer damage is beyond me, the only way I can forsee this is if somebody had been pulling at my pendant pretty hard to have metal snap however in that case surely the chain itself should also have snapped if it was being pulled with such force? I am so mad and don't know what to do next! They are relatively expensive jewelry and I don't think it's right they can just fob you off like that when it is clearly a defect in the metal. Can anyone advise me? Thanks.

You need to prove that it is a fault with the pendant and not customer damage as they state.
The only way to do this is to take it to an independant and get them to inspect it and write a report on their findings.
If they find it is an inherant fault with the pendant and not customer damage. Then you can enforce you right under the Sale Of Goods Act.
Just bear in mind you will need to pay for this report...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands
