    Thank you again...and feel awful I didnt put FYP and dojoman in OP-and they both helped me lots to as did blind as a bat....turning into an oscar speech...shut up kerry...ok then :rotfl:

    Its lovely to see the community still going strong here-and my god have you lot been doing some posting surely phil and confused have RSI?!!! Nearly choked on my coffee when I saw post counts!

  • can i ask a question please , what is the format after BR is granted .wen you !!! out of court , n you have a bank account what happens with the OR interview? what do you repay and things? what do the OR need to see and have from you ? how do they check on you through the time you are BR.are you allowed your own money or what happens? thank you all for your help so far, just what i think of during the wee small hours .i dont know how to feel, relieved , scared happy x

    You might get a better response if you posta fresh thread as more people will see it but you can also get some information on the insolvency website www.insolvency.gov.uk

    You need to take advice from a debt charity such as national debtline, CCCS or citizens advice bureau to make sure bankruptcy is the best option for you. They can also help fill in your Statement of Affairs, which is the document you fill in to file for bankruptcy, and is a sworn court document. You can also get lots of fab advice here on that too.

    On it you will list all your creditors, and also detail your reasons for bankruptcy. You will also declare all bank accounts assets over £1000, all cars and savings. You detail your income and also your basic living costs such as rent, council tax etc.

    Last time I looked it cost £510 to declare yourself BR-£360 plus £150 court fee. The court fee may be waived if you claim certain benefits.

    Once you decide to file for BR, you need to book a date at your local county court (outside London) or High court (if you live in London) There is normally a wait. You need to pay cash on the day of the hearing.

    On the day, you attend court. You will swear on your Statement of Affairs. The judge will normally ask to see you-normally this is brief and in chambers-and you are generally asked if you are sure and whether you took advice. Then you are declared BR.

    You then return to the front desk to wait for the Bankruptcy Order. You will normally speak to your official receiver briefly on the day-sometimes at court, sometimes they phone you later. This is just to confirm basic details and to ask whether any assets are in danger ie bailiffs for example.

    Then you will hear by post of your interview date. Most people seem to get phone interviews, some get face to face. You will need to clear 2 hours for this-so arrange childcare etc if needed.

    Hope that is helpful, but to get more advice, speak to a debt charity first and post a fresh thread to get the best response.
