Purchasing a car

I am writing this on behalf of my mother.
A few weeks ago she went into a dealership to purchase a new car.
Today she was informed that they offered her too much money for her car and that they want her to pay more money or not recieve the car (It was a new car that is currently being built by Skoda)
They say as the order form was not counter-signed by anyone (she signed her bit) they do not have to honour their agreement.
Who is right? My mother who is expecting to receive her new car in September or the dealer who "forgot" to sign the form.
Any advice would be appreciated!

My money is on your mother. Having said that you might have a fight on your hands, and it might not be clear cut.
Is it an obvious mistake? (ie did they offer £10k instead of £1k trade in)0 -
An Order Form isnt concrete. Signed or not.
If it was an INVOICE then things would be different.0 -
Sorry let me add
They offered her £5750 instead of £4750
she has also paid a deposit0 -

Sounds like yet another dodgy car dealer to me, trying to squeeze another grand out of the deal, I would take the matter up with Skoda UK.0 -

I think I should also point out that I work for the same dealership in a none selling capacity and when she purchased the car they didn't know she was my mother and I didn't know she was buying a car.
I want my mother to get what she was offered but I don't want my working life to be made miserable0 -
Have you read the terms and conditions on the order form?
Despite the fact they haven't signed it (so its even more worthless than it would've been) i expect it gives them a get out clause.
Failing that they have to refund the deposit and your mother could if she wished sue for breach of contract, however any damages would have to be forseeable by the dealership in question.
The sum total is unless you can get Skoda or more likely the Dealership HQ to put pressure on to honour the deal forget about it and move on.
Its not fair or right but its a cruel world.0 -
How much off the list price did she get? Whats your staff discount?
Is she getting it for a price as good as offered by http://www.drivethedeal.com/ my local Skoda Dealer could not believe the discount I have got on a New Octavia basically said he should be ordering his metal from Drive the deal! instead of Skoda.0
