Ebay item not as pictured

Hi

Usually I lurk a lot on the boards and have had a search for something similar but couldn't find anything - I apologise if this has been asked before.

I bought a box set of books from ebay and it was received ok (took a while as it was returned to sender for some reason). The set is exactly as described - brand new and still in plastic wrap. My only issue is that the item does not match the picture. The books are the same but it was bought to match a child's bedroom. I understand that this is a minor problem but to be honest I could have bought the set which I received on another website for less. I assumed I would be receiving the one in the picture for which I was prepared to pay a little bit more.

The seller does not accept returns and I was wondering if anyone could advise me if there is anything I can do in this circumstance. Fair enough if I can't but I don't use ebay very often and this is the first time I have been disappointed. I have thought about contacting the sellar but have no idea how to word the email.

Is there anything I can do? Any advice would be gratefully received.

    Sellers cant refuse returns if its a snad then you have to return the item and the seller has to refund,

    Does this apply if it is only the picture which is misleading? The description is correct, I don't dispute that. Do I contact the sellar first and see if they will take it back? I assume if they say no then I have the right to open a dispute - not sure how but going over to read up all the rules on ebay and get them straight in my head!

    Was it a real picture or a picture that is on google images? If they claim the item is that in the picture then it could be classed as SNAD

    Always contact the seller first. Be friendly and polite.....thanks for sending the item so quickly, blah blah blah.

    If they are not responsive and you still feel it is SNAD, open a PAYPAL not Ebay dispute. Ebay disputes are a nightmare.

    Thanks for the replies. I realise now it was a probably a google images one although if that is the case then why not find one to match the item being sold? However, I am going to email the sellar and see if they will accept it back. Not feeling too hopeful though but I'll give it a try.
