car insurance claim

Hi please can anybody help my sons froiend who is now 21 was involvded in a car accident last December. His car was hit from behind and was a write off. He had three other passengers in the car 2 of them have claimed for injuries and have been paid. The insurance company have also settled on the car,but now there is an ongoing battle and a courtcase looming,because the driver who suffers from whiplash and has been to a chiropractor is being taken to court by the person who hit him. They are claming he stopped on purpose ,even though he was on a roundabout. This friend is an honest hardworking law abiding citizen and they are now asking for bank statements etc for three months before the accident and it is going to court. His claim has not been settled. His insurance solictor does not seem to be helping him can anyone help please !!!

  • I don't see how the driver who hit your friend in the rear can take your friend to court and now claim he stopped on purpose, when your friends mate's have been paid for injuries, and your friends car has been paid for, that would suggest to me that when the accident occured the driver who hit your friend in the rear was deemed liable for the accident, and his insurance company paid out accordingly?

    It could also suggest that the OP's passengers claimed off the OP's insurance, and that the OP's insurer also dealt with the car damage.
  • In todays claim happy enviroment its not uncommon for a car full of people to manufacture a crash in order for personal injury claims to take place. Now im not in any way suggesting this is the case but merley giving the facts as to why it might be being questioned.

    True, would need confirmation from the OP as to who was deemed at fault when the payouts were recieved, and who they came from, to properly gauge the situation.
