Barclays/Aviva

:(:(Has anyone else experience problems with the aformentioned company regarding an insurance claim? We have had no end of trouble and a year later r still awaiting a decision to be made regarding items that were damaged in our garage as a result of a young boy racer losing control of his car and crashing into the garage, which subsequently had to be demolished. We were told that the items being claimed for could not be paid out on because they were business related (my late father was a self employed refrigeration engineer). They then got back in touch n said thast because my father was deceased and they were no longer being used for business we could actually claim, we had to get the quotes for the items which we did n because it came to over £10k they are now digging their heels in and they have sent a loss adjuster who has basically said no we will not be paid for them. We have been in contact with the FOS. Just wondered if anyone had any suggestions or what to do next???

    Why don't you claim off the boy racers insurance?
  • it all has to be done through our insurance apparently, but think may try giving that a go, whats the next step?

    Write to the third party, saying you hold their insured responsible for the incident and enclose a quote for repairs together with a schedule of damaged items. Ask them to reimburse you and take it from there.

    Be aware that if you claim directly from the other Insurers that they will not normally pay on a new for old basis, but you won't have to worry about single article limits, whether the items were used for business or under insurance etc.

    If the car damaged the garden etc at the same time then you can also claim these costs from the other Insurer
  • well the saga continues, Barclays phoned yesterday and made an offer of £2500, for loss of expectations! They are again saying that the tools were not covered and they made a mistake by sending a letter to say they were but a year later they have only just realised, have told them will not accept this as i think they know they are in the wrong so we are waiting to hear from the CEO, hopfully next week. If we do not get any joy then it will go back to FOS and i will make this as public as possible. Mt poor mother is at her wits end:mad:

    I would speak to a solicitor with view to pursuing a claim against the boy racer.
