I have been waiting for my purchaser to complete since Feb of this year...

I lost a previous house (that I had agreed on and done valuations etc) because my purchaser ran into minor!!! problems
1. There was a clause that he couldn't sell house given to him by mother wihtout her permission....and she wasn't giving it.
2. Part of his drive was on land that belonged to someone else....

So sale fell through and on we went. In the next 3/4 months I had no serious offers and this guy came back, saying everything was sorted now... As I was still uneasy my estate agent (my mistake I should have got solicitor on to it) spoke with his solicitor who guaranteed everything was in order, land was sorted and mother had given agreement....

Guess what... Now that another valuation has been done on new house and date for handover is fast approaching end october. And I start asking questions why we are not exchanging turns out land problem is still an issue (after a long delay because this guys solicitor hadn't passed proper documentation through....

My solictor seems to be doing ehr bit she has been phoning directly the three solictors in chain (two below) and one above trying to get to bottom of this. Last week she was saying we should put a deadline down, however turns out now that the solicitor at the top (the new build I am buying) is from same firm as the guy at the bottom (buying house with drive on someone elses land who wants money for it).... He recknos the house builder will give me time and hold price (for how long?) and he is going to chase up with his partner who returns next week to look at this issue re drive. My solictor now suggests we sit tight and wait....

The waiting is killing me, we have kitchen suppliers, bathroom suppliers all chasing us to confirm orders, obviously we can't....Im tempted to phone my buyer direct, but not sure if it will make matters worse as I can't trust them anyway....

Why does this have to be so complicated...

  • There is not a lot you can do really :( I'd suggest ringing your solicitor and finding out exactly what the delay is (i.e. Know everything.. what it takes to sort it.. realistic time lines.. who does what.. possible delays etc). Then ring the EA and say "this should take xx days to resolve if it is not I want to know exactly why". As you say you can't ring the vendor as you do not trust them..

    Setting a deadline will only work if you are prepared to pull out.

    Problem is when you are ready to go and just waiting for some one else everything seems to take ages.

  • how awful. sorry to hear you are having so much bother. hopefully your solicitor will be able to sort this out.
  • I know how awful, stressful and frustrating the wait can be.

    I would suggest setting a personal deadline (say 1-2 weeks) and then making a plan of action - whether that is stating you will pull out or otherwise etc. Taking the process in bite size chunks and setting personal deadlines allow you to relax (a little bit) in between and allow you to take some control.

    Meanwhile if there are EA's involved get them to do some proper chasing as they will not want to lose their commision.
