Clydesdale Bank ignoring Fos and me - what now

in July last year I made my first contact with cb to have the ppi on my mastercard repaid. In April this year the fos ruled in my favour and cb agreed to recalculate my statement, removing all ppi charges etc.

I was advised this could take 8 wks but no longer than 12. It's been 17.

I've wriiten to cb twice and called and according to Fos I need to raise ANother complaint with them - but surely this is the same complaint? It took 3 months to get the Fos's original ruling!!

What do I do? Interest is still being applied to an amount I technically don't entirely owe.

I shoul add that a bank employy ticked the box on the form requesting ppi. Isn't that fraud and illegal?

    Let me get this right.

    So the FOS resolved your complaint against CB, and CB agreed to the adjudicators decision, and CB have not resolved this yet 17 weeks on?

    Normally the FOS (adjudicator) who dealt with your decision would chase them up for you, if this is the case, but otherwise I assumed if being ignored by the company (CB), then your case would then have to be moved on to the ombudsman himself.

    I would contact the adjudicator again on this matter, I can't see why it should be a brand new complaint, when this have already been investigated and resolved by the FOS.

    In regards of the interest, they would have to award you that as well, so the longer it takes, then the more they will have to award you.

    It should have been up to you to decide whether you wanted PPI or not, and in this case you would tick and then sign, but yet its been known for people to have signed and the box have been ticked afterwards, yet not by the customer.
    Sometimes its the banks own automated tick or cross.

    I was thinking though, when the FOS said about raising another complaint with them, I wondered if they did actually mean on the unfairness of the timing its taking, as yet another complaint.

    It would be useful to find out who the Chief executive officer (CEO) is for CB, then you could write to him or her, if I find them I will post them up for you, meanwhile though, I would double check on this matter with the FOS.;)

    Can i ask how long it took for the FOS to come back to you regarding Clydesdale bank. My complaint is currently with the FOS and has been since early May 2010

    Hi Leela

    I know that the FOS are taking on new staff all the time to try to keep up with the demand of these complaints.

    The longest part is actually waiting for it to be passed on to an adjudicator.
    Then if straight forward, some have stated as from 8 weeks after its been allocated.
    If more complexed and the company/bank does not agree with the decision, then normally its passed on to the ombudsman himself, if this happens they do normally agree with the adjudicators decision and therefore - you would then generally be awarded further redress for distress and inconvenience as well.

    So although its difficult to put in a timescale, say for example, as soon as its passed on if straight forward - 8 weeks, and it used to be that it could go on for approx 18 months if complexed but it seems they are now resolving them far quicker now.
    I do think the timescales have been brought down from a month to a fortnight when the FOS request for further information from the company, yet they do tend to still ask for further time.

    Hope you won't be waiting too long.

    What I would like to say is though, if your in any financial struggle - hardship, let them know and request for fast tracking.;)
