leaking roof

I have lived in my semi detached house for 21 years and look after my roof, my property and my neighbours are like two L shapes joined together, the up shot is that a joint gulley has 50% over my property (I have the down pipe) and 50% over theirs, they have lived there 11 years and have never done a thing with their side of the roof and it now leaks into my home, they know it leaks and they keep putting bitumen etc. on it but each time it only holds for a few months and is getting worse, I am now putting something together for my insurer, is there any reason why my neighbour won't repair his roof, is he hoping that either myself or my insurer will pay to do it?

The neighbour is responsible for damage caused by his leaking roof.
If you insurer wont pursue it, and you are left out of pocket, then if you can prove that his roof is the cause, then you can sue in the county court (small claims) to make him do a full repair and compensation.
Alternatively, the local council environmental health dept has power to force him to do a full and permanent repair within 21 days or face prosecution in the magistrates court - you allege that it is a Statutory Nuisance0
