Business Lease

I have been operating my ice-cream business for 11years, i rent my premises from the council, i had a 3 year lease , it was renewed untill 2006, i have been trading since that time, constantly asking for a new lease, my rent was paid as and when they decided to send a bill, i currently have 2years rent put by, i pay the rates every year. I have just received a letter from the council , they are prepared to issue me with a new lease, the rent £4500 backdated to April 2010, i only open seasonally (April - September), i know i havent had a rent increase for 4years but am a bit annoyed that with only 6weeks left of this season i need to find the extra, also the new lease is excluding the Landlords and Tenants Act 1954 so i have no secure of Tenancy, can they do this, i feel very dissapointed as i have built a small business and they can just take it all away in 3years time, any advice on this would be grateful .They have given me 14days to reply.

    If you have 14 days to reply my advice would be to see your solicitor today as the clock is ticking...it shouldn't cost much for them to give it a quick glance and a yes or no, though of course in depth follow up advice will be more.

    I hope you get it sorted, I heard of a number of touristy businesses building up an area and getting a loyal following then being kicked out when they've done their job so the big boys can be moved in.

    I think that's an opening offer from the council, go back to them and say you can't afford it but could pay £x. They'll negotiate, everything is negotiable!!
