Went to a local shop bought some stuff including a bottle of Orange Fanta, I got home took one drink and noticed hmm that is abit off, I checked date and says Jun 10. And its getting all dark.
Should the local shop give me a full refund. And what if they refuse to give me.

Take it back, speak to them calmly and see if they have other OOD bottles.0

Is it 'before before' or 'out of date' (or similar wording)? The former is just a recommendation, the latter they must not sell goods with.
I'd expect a full refund. If they've lots of goods on their shelves like it them report them to Trading Standards.
EDIT: Erm, actually meant "best before", damn typo!0 -
As above, take it back and get it swapped. I bought 8 month OOD chocolate from a store near me, they exchanged it. A week later the OOD chocolate was still on the shelf so I handed it to the girl at the till. A few months later I again noticed the chocolate was still on sale. I assume they hoped to get rid without anyone noticing. At that point I reported them to TS.0

It's gone off in less than five weeks after it's use by date?
And there they are bringing back Shackletons Scotch from the Antarctic over 100 years later, better not buy any OP just to be on the safe side.........:rotfl:0 -

May goodness, it was saucy in the Eighties!0 -
It's illegal to sell products past their 'Use By' date. All other dates (Best Before, Display Until) don't have the same credence and are intended as a guide. I strongly suspect that a bottle of drink will have a Best Before and not a Use By date but that's not to say that the contents are still pleasant to drink. Regardless of non-Use By dates, you can't sell a product in a 'misleading fashion'. This is why typically shops chuck out of date stuff in a basket with a label stating it's out of date and a reduced price. Trying to pass out of date stuff off as in date is misleading. However, it would be incredibly difficult to prove that it's not an honest mistake (therefore no intention to deceive). Nor can shops sell something that's not fit for consumption. So if your drink has deteriorated to the point that it makes you ill, then they could be breaking the law. But it would be nigh-on impossible to prove that the deterioration didn't happen after you bought it and as a result of something you'd done.
The shop, out of good will, will probably refund you. Why not ask them? I would say though... it's a bottle of Fanta. Some things just aren't worth the hassle!"Growth for growth's sake is the ideology of the cancer cell" - Edward Abbey.0 -

Soft drinks, usually have a best before date.
This isn't always apparent, as the bottles usually only have a date stamped in a dot matrix kind of fashion. The explanation of the date is usually on the shrink wrap packaging of the wholesale pack.My farts hospitalize small children0
