Please can anyone help?

Hopefully someone can help me out here!

I have just rented out my property, and currently have an ongoing boundary dispute (Scotland) and access problem.
Presently I have a building's only policy which has legal protection, no claim has been made to date for any of the expenses (I foolishly didn't realise that this was covered) and I know that I can't reclaim previous cost's.

I am now close to having to raise a Court Action.

I am aware that I will have to change my current policy to a Landlord's or approach my current provider to change my policy.

My question please if someone could help:-

If I take out a a new policy say today will any future cost's I wish to claim be covered by the legal protection on the new policy. Or will they say its one of those pre-existing thing's.

I hope this makes sense.

    No, you won't be able to buy legal cover for an event that's already happened in this context.

    Hi thanks for your response are you saying a new policy with legal cover will not cover this issue as its pre-existing, as I haven't made any claims against my current policy regarding this issue. I'm worried if I make a claim on the current policy that they say no if they find out the property has been rented out.

    Neither your current insurer nor any future insurer will cover legal costs for the battle you've already started.

    Sorry to sound stupid, but the battle really hasn't started - only exchange of letters between solicitors, my next step would be to raise a Court action to stop my neighbour blocking my access. There is no time scale in which I have to do this.

    I'm not sure if that's true, as my curent insurer would cover this dispute going forward if I hadn't rented out the property, they clearly stated that they would not let me reclaim cost's to date.

    One of the basic provisions of any legal or liability based policy is that you notify the insurer as soon as an event occurs which does, or is likely to, give rise to a claim. In this case the "event" would have been when you were first aware that the boundary in question was contentious.
    42 years of experience in the insurance industry.
    And nothing the industry tries do to us surprises me any more!
