Termination of a tenancy by the tenant

Options
Please can someone advise if this is correct:

To terminate your tenancy, you must give a minimum of one months notice in writing to A.N. Other property rentals, the notice period is to commence from the 'tenancy commencement date', of the original tenancy agreement.

So in effect one can be forced to give 2 months notice if they have just missed that anniversary date......

Thanks

To terminate a tenancy you leave at the end of the fixed term with no notice required or you leave at the end of a rental period having given one months notice to end at the end of a rent period. If your rent is paid monthly for the 9th of one month to the 8th of the next, then you would need to give notice before the 9th of one month to leave by the 8th of the next. So if you were late and didn't give notice til the 10th you would be stuck for nearly another month.

Are you discussing a fixed term tenancy or periodic tenancy (which automatically happens when a fixed term expires and the tenants remain in place)?

One month notice from the tenant, if the rental period is monthly, whose expiry is timed with the rental period date. It can be given at any time but it's not simply a case that it is simply a case of giving a months notice at any point during the tenancy, the timing of issuing it (when it is due to expire) is critical.

Missing it by a day means the tenant is liable for the entire next month's rent unless the landlord consents to less.

The Shelter website gives an excellent description on how to end a periodic tenancy, including an example.
  • I understand perfectly now, thanks for your help.
