HELP - TV purchase from Marshall Ward gone Faulty!!

Hi,

Just a newbie here folks but was told to join by a friend as people on here are so helpful!!:beer:

I purchased a tv from Marshall ward on January 25th this year, Lg 42" lcd. It was £499 but with discount codes i paid £369 for it.

On tuesday this week a blue line appeared down the middle of the screen, i phoned marshall ward who arranged for a company to repair the tv. Today i phoned said company and they told me it was beyond repair and i was to contact MW.

I phoned them and was told they would credit my account the £369 i purchased tv for as they did not have a replacement available, this now means i have no choice but to buy another tv from them and can i cant get a tv anywhere near the specification of my original faulty one for this price!! I paid alot of money for someone to install a bracket on my wall to suit this tv and now im going to be left with a tv thats smaller than the bracket as i can only get 32" for this price!!!

Do i have any rights to demand same spec or at least same size tv or i am just to accept the refund and pay the extra to get the same??

Any help appreciated guys. Thankyou.

    You paid £369 for a TV and MW have given you a full refund over six months later, they've done exactly what they are legally obliged to do, if not more so.

    Exactly what Neil has said - not sure what else you expect - after 6 months (or even less) the retailer can offer refund / replacement / repair - but it is their choice.

    I think the problem is they have refunded onto the account meaning they have to buy the new TV with them , a bit like a credit note i guess.

    Bear in mind that they are quite within their rights to give you a partial refund only, amount dependent on the usage you've already enjoyed.

    I am only unhappy as i cant get the same spec tv again, i would have preferred a replacement in otherwards. I dont see how it is right i can now only buy a less spec and smaller tv for the same money and from the same company as i cant go anywhere else.

    Can i demand they replace it rather than refund my money?

    Nope.

    Im not sure but cant you ring them once the credit is showing and ask they to put it into you bank ?

    Not sure legally they are allowed to give a credit note for a faulty item ?

    Agree, see if you can get the credit refunded in the form you originally paid. Does seem a little unfair to be stuck with a credit note that won't be sufficient to replace the TV.

    I would think legally you'd be entitled to a proper refund (since they can't repair or replace) although as mentioned it can be a partial one to reflect the use you've already had of the TV. Whether this is a suitable alternative is up for you to decide.

    To the OP .... did you have some form of credit account with them - is this why they put in account - I would expect refund back to card or cash.

    Hi,
    yes we bought it on account with MW, It was buy now pay march 2011, i paid it off last month. So i will now be in credit with them and have to in effect pay more for a similar spec tv!

    Hmmm ... ok .... but as you don't owe them any money, I don't see how they can keep the money - just ask to close the account & have the money sent to you?

    What have they said to this?
